ACNC Issues PBI Guidance

The Australian Charities and Not-for-profits Commission (ACNC) has published a new Commissioner’s Interpretation Statement on Public Benevolent Institutions (PBIs).

It outlines the ACNC’s current understanding of the law concerning PBIs and how organisations may fit the charity subtype. The statement is binding on ACNC staff during the decision-making process. The release of the statement follows consultation with the public, charity sector members and professional advisors on an Exposure Draft Statement issued earlier in 2016.

Assistant Commissioner General Counsel, Murray Baird, welcomed the release of the statement, highlighting the important role it will play for many in the charity sector.
“Public Benevolent Institutions are a particular type of charity and have long provided important services in the community,” Mr Baird said.
“These charities are set up to help relieve poverty, sickness, disadvantage and suffering.
“Many organisations seek registration as a PBI, and the Commissioner’s Interpretation Statement will provide clear guidance on the criteria for registration.”
